DMCA & Copyright Policy
Digital Delights respects the intellectual property rights of others and expects our users to do the same.
At Digital Delights, we are committed to complying with U.S. copyright and related laws, including the Digital Millennium Copyright Act (DMCA). Because our platform hosts a vast library of digital assets, we have established a clear protocol for addressing claims of copyright infringement.
If you are a copyright owner or an agent thereof, and you believe that any content hosted on Digital Delights infringes upon your copyrights, you may submit a notification pursuant to the DMCA.
1. Submitting a DMCA Takedown Notice
To file a copyright infringement notification with us, you must send a written communication that includes substantially the following information (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Original Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on our website are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide information reasonably sufficient to permit us to locate the material (e.g., the exact URL of the product page).
- Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
2. Submitting a Counter-Notification
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a Counter-Notification must be a written communication provided to our Designated Agent that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which Digital Delights may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Digital Delights has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users or vendors who are deemed to be repeat infringers. We may also at our sole discretion limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
