Digital Delights respects intellectual-property rights and provides this process for reporting material believed to infringe copyright.

1. Copyright policy
We expect products, listings, and materials made available through Digital Delights to be authorized and lawful. We may remove or restrict access to material when a valid complaint is received or when infringement is otherwise apparent.
The process below is intended to address notices under the United States Digital Millennium Copyright Act, 17 U.S.C. § 512. Other copyright concerns may also be sent to the same contact and will be evaluated under applicable law.

If Digital Delights seeks U.S. service-provider safe-harbor protection, the agent designation must also be registered and kept current in the U.S. Copyright Office directory. Registrations expire and require renewal.
3. Notice of claimed infringement
A copyright owner or authorized agent should send a written notice containing substantially all of the following:
- A physical or electronic signature of the owner or person authorized to act for the owner.
- Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works on one site are covered.
- Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it, preferably the exact Digital Delights URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Send the notice to the designated agent above. General product complaints or trademark concerns should not be labeled as DMCA notices.
4. How we may respond
After receiving a substantially compliant notice, we may remove or disable access to identified material, notify the affected provider or user, request missing information, preserve relevant records, and take other steps required or permitted by law. Removal is not a determination that infringement occurred.
5. Counter-notification
If your material was removed or disabled because of mistake or misidentification, you may send a written counter-notice containing substantially:
- Your physical or electronic signature.
- Identification of the removed material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the appropriate U.S. federal district court—or, if outside the United States, the federal district where the service provider is located—and agreeing to accept service of process from the original complainant or that person’s agent.
Where the statutory process applies, material may be restored after the legally specified period unless the original complainant informs us that a court action has been filed.
6. Repeat infringement
In appropriate circumstances and at our reasonable discretion, we may terminate or restrict accounts of users who repeatedly infringe copyright. We may also address obvious or serious infringement involving a single incident.
7. Misrepresentation warning
Knowingly making a material misrepresentation in a takedown notice or counter-notice may result in liability. Consider fair use, licensing, public-domain status, and other lawful uses before submitting a claim. Seek legal advice if uncertain.
